Typically, a DUI stop is effected by law enforcement when some minor traffic infraction is alleged to have been committed. If the officer suspects the driver of committing a DUI, he or she will usually request the performance of several field sobriety tests. Afterward, a PAS test, or a preliminary alcohol screening device, is usually administered to the driver. If the results of the PAS test are at a .08 blood level alcohol or greater, the officer will usually arrest the driver and transport him or her to the local county jail.
Once at the jail, the driver suspected of driving under the influence should be given a choice of either a blood or breath test to determine his or her blood alcohol content. At this point, the driver cannot refuse to take the chemical test and criminal enhancements may be imposed for any refusal. However, the police may not forcefully take a breath sample or blood draw unless done under safe, medically approved procedure. While the result of breath tests are usually readily available, blood test results will take several weeks to be determined.
From there, a future court date will be given to the driver and law enforcement will submit a police report to the local District Attorney’s Office for a DUI prosecution. The local District Attorney will use the police report to determine whether the driver was lawfully stopped, tested, and arrested. If the local prosecutor believes that there is a valid DUI case, a criminal complaint and formal charges will be brought against the driver.
